It was left to the judges to suggest that a better method was to produce scientific evidence of the ills sought to be stopped, and to also note that the governments own health ministry had already said the ban should be removed.
We arent entering here into the merits of present law versus the proposed one. Our concern is with the governments strange inability to make up its mind one way or the other and to make a legally sustainable case for telling the judges to let it handle the issue.
The second case is weird, since the law and home ministries are opposed to the health ministrys affidavit, which was filed anyway; the matter came up in the Union cabinet last week and the Prime Minister advised the ministries to discuss and sort out the matter. Something that should have been done as a matter of course at the outset.
As an indication of the basis on which legislation is made or not made, these examples are illustrative, if rather depressing. The legal acumen of the ASGs in question isnt in doubt, so the cause appears to be the sort of briefing they get from the ministries in charge. Which are also unable to present a combined stand even after being adjured to give one

It is, first, worth mentioning that the summit did not commit the ANC to anything
